Thomas “Tommy” McClain was shot and killed by Eureka police in front of his family’s home just after midnight on September 17, 2014.  He was 22 years old.

There has been no arrest of officers involved in this shooting, and the “investigation” of this shooting is being handled by the Eureka Police Department itself.  Chief Andrew Mills has said he will be responsible for deciding the fate of Stephen Linfoot, one officer named in the killing.

Troubling and changing details have been trickling out of the Eureka Police Department, but still no clear explanation of Tommy’s death exists.  Tommy’s family and others in the community are still seeking answers.

We, the undersigned, as concerned citizens are symbolically requesting a coroner’s inquest, since we do not hold the legal power to formally request one.  We are also requesting that those who do hold the legal power to request this inquest do so, without delay.  Those persons/groups include:  Humboldt County District Attorney, Paul Gallegos, Humboldt County Sheriff, Michael Downey, Humboldt County Grand Jury, Eureka City Attorney, Cyndy Day-Wilson, Eureka Chief of Police, Andrew Mills, and California Attorney General, Kamala Harris.

  1. At least one organization is speaking out. Where is the ACLU? Seriously, isn’t this the EXACT type of case they would generally grab a hold of. Tommy was a low income young man shot to death on his own property. He posed no real threat to the police and there was no real reason for police intervention in the first place!

    I’m glad Copwatch is doing something. I’m sickened that the ACLU has been completly silent. Giving Richard Salzman an award earlier this year was great. But if that’s all the ACLU is good for than this county is worse off than I thought.

    • In addition to being insulting to McClain’s family and friends, Chiv’s post makes no sense. Bergel and Arroyo don’t appear to have any real difference of opinion with Newman and Albin on this issue. Unless I missed something, none of them have raised any concerns about the EPD’s actions in this case, and certainly aren’t trying to make it a campaign issue. Meanwhile, my sense is that quite a few prospective Bergel and Arroyo voters DO have concerns with the EPD’s actions in this case — both in terms of the shooting itself, and the (self)investigation that followed. Whereas I’d hazard a guess that Newman and Albin voters are more likely to assume that the shooting was justified, and less troubled by the EPD’s (self)investigation.

      It’s hard to see how highlighting an issue where Bergel and Arroyo are less in tune with their progressive base and Newman and Albin are more in tune with their moderate/conservative base would be helpful to Bergel and Arroyo. It makes no sense.

  2. Chiv is the first to cry foul with someone offends him or his handlers, but his insults and superior attitude are in full display on his blog. He sees everything as political, even when its not, like today’s demonstration. He reminds me of the R. Cumb cartoon character Mr. Snoid. I think the TE should run a picture of Mr. Snoid so readers can see what I am talking about.

    • Chiv’s whine about the timing of the protests (2 weeks before an election) is particularly odd as is his belief that expressions of free speech must be “master minded.” I don’t read his blog so don’t know if circular logic is a chronic condition or intermittent/situational; but the timing of the protest was because of the timing of the event which triggered it, not upcoming elections.
